Please read the Terms and Conditions of Sale carefully as they are the basis upon which bookings are accepted by Get Me Enterprises Pty Ltd ABN 14 130 402 452 (Get Me Learning Resources)

1.  Prices & GST
(a) All prices quoted are in Australian Dollars and are subject to additional Goods and Services Tax (GST).  

(b) In event of the GST rate being increased between the booking confirmation and an invoice being issued the client (You) will be liable to pay such increase before your advertisement is published.

(c)  Prices are valid until 31st December 2009 unless otherwise stated.

2.  Price Changes
(a) All prices are subject to change without prior notice until Your booking is confirmed.

3.  Payment
(a) All bookings must be paid for in full on receipt of invoice by direct bank transfer. 

(b) Payment in full is required prior to publication of advertisement.

4.  Changes to Advertisement Content
(a) Get Me Enterprises reserves the right to amend the content of an advertisement to improve its readability or suitability to its community without the prior approval of the client.

5.  Cancellations
(a) Bookings cancelled 5 business days or more before scheduled publication will be refunded in full. 

(b) Bookings cancelled less than 5 business days before before scheduled publication will not be entitled to a refund. 

(c) Any cancellation must be advised in writing to Get Me Enterprises either by email, fax or letter.

(d) In the event that confirmed advertisement booking is cancelled by Get Me Enterprises, all booking fees paid will be refunded in full or alternative promotional opportunities will be offered for Your consideration.

6.  Featured Listings
(a) These advertisements are text only and all content is to be supplied by the client

(b)  Only 2 consecutive bookings will be accepted at any one time and only 6 bookings will be accepted over a 12 month period

(c)  Booking deadlines are 3 working days before the distribution of the fortnightly newsletter which will usually take place on a Tuesday 

(d) Advertising space is limited and will be allocated on a first come first served basis

7.  Banner advertising
(a) Banner ads to be maximum 150x38 pixels in size

8.  Events
(a) Client to supply all advertising content relating to the event.

(b) Where 10 packs are purchased, any unused credits will expire 6 months after the original booking date. 

(c) The client will not be entitled to any refund for unused credits. 

9.  Liability, Warranties and Indemnities
(a) Subject to clause 6(c) Get Me Enterprises makes no express warranties beyond those stated in these terms and conditions. All conditions and warranties implied by statute or common law, are to the extent permitted by law, expressly excluded.

(b) To the extent permitted by law, Get Me Enterprises excludes all liability to You for any loss or damage suffered by You or any other person howsoever arising (whether in negligence or otherwise). In particular, Get Me Enterprises will not be responsible for any indirect or consequential loss or damage of any kind in contract, tort, under any statute or otherwise.

(c) Where the law implies any term into these terms and conditions and it is prohibited to exclude or modify such terms, Get Me Enterprises' liability for breach of such terms is limited to one of the following options (at Get Me Enterprises' option):

(i) the re-supply of the agreed services (or equivalent services); or

(ii) the payment of the cost of re-supplying the services (or equivalent services).

(d) Except where clause 6(c) applies, the total liability of Get Me Enterprises to You or any other person for loss or damage will not exceed in aggregate the total amount of the fees payable for the advertisement(s) booked.

 (e) Neither party will be liable for any delay or failure to perform its obligations under these terms and conditions to the extent such delay or failure is caused by a malfunction of any part of the internet or either party's internet infrastructure.

10. Privacy

(a) Get Me Enterprises collects personal information from You for the purpose of contacting You to discuss the booking and invoicing You for the services.

(b) Get Me Enterprises will not disclose Your personal information to any third party unless required by law or You consent.

11.  Governing Law
(a) These terms and conditions are governed by and construed in accordance with the laws of New South Wales and the parties submit to the exclusive jurisdiction of the Courts of that State.
